1. INTRODUCTION
These Terms and Conditions govern the sale of goods and provision of services by ConstructPC Ltd (“ConstructPC”, “we”, “us”, “our”) to customers (“you”, “your”). By placing an order, requesting services, submitting an enquiry form, approving a quotation, or purchasing goods from us, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. Nothing in these Terms affects your statutory rights as a consumer under UK law.

3. DEFINITIONS
“Custom Build” means a PC, workstation, or system built, configured, modified, assembled, or supplied to your unique, agreed specification.
“Standard Goods” means goods sold from stock which have not been built, modified, configured, personalised, or supplied to your bespoke specification.
“Refurbished Goods” means pre-owned, repaired, tested, cleaned, restored, or prepared components, systems, or tech sold as refurbished or used.
“Services” means diagnostics, upgrades, assembly, testing arrays, installation, configuration, setup, cleanups, tuning, or repair work carried out by ConstructPC.
“Quotation” means an estimated price, technical specification, or project proposal provided before work begins.
4. BUSINESS MODEL AND SERVICES
ConstructPC Ltd provides a hybrid range of technology goods and services, including custom-built desktop PCs, desktop PC upgrades, diagnostics, component repairs, refurbished/pre-owned technology, and individual components. Custom builds and repair services are primarily focused across Northwich, Cheshire, and the wider North West region, with local collection, physical handover, or dedicated delivery arranged where practical. E-commerce shop items may be offered for delivery across the UK where explicitly stated.
5. ORDERS AND ACCEPTANCE
A binding contract is formed only when we confirm acceptance of your order in writing or begin providing the workshop services, whichever happens first. We reserve the absolute right to refuse or cancel any order or technical enquiry prior to formal acceptance due to component stock unavailability, market pricing fluctuations, component compatibility flaws, safety/practicality concerns, failed payment validation, or if the requested work falls outside our stated service offerings.
6. QUOTATIONS AND ESTIMATES
Upgrade, repair, and custom build work is quoted individually. Quotations are based entirely on hardware availability and vendor rates at the time of issuance and are valid only for the specific period stated. Component prices are subject to rapid shifts. No parts are ordered and no build or repair work begins until the final technical specification, quote, and payment terms have been explicitly agreed upon. If unexpected complications or further component failures are discovered on the test bench during a service, we will suspend work and seek your explicit approval before proceeding with additional material costs.
7. CUSTOM BUILDS & BESPOKE CONTRACTS
Custom-built systems are bespoke goods configured, sourced, and manufactured directly to your individual specification. Upon your payment or invoice/quotation approval, ConstructPC Ltd enters an immediate, non-cancellable procurement obligation with wholesale hardware distributors to secure your specific components. In accordance with Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, contracts for the supply of goods made to the consumer’s specifications or clearly personalised are strictly exempt from statutory 14-day distance cooling-off and cancellation rights. Cancellation is entirely at our sole discretion once components have been ordered from our suppliers or workshop assembly has commenced. This does not affect your statutory rights if the system is structurally faulty, misdescribed, or non-conforming under the Consumer Rights Act 2015.
8. PC BUILD PLANNING AND ADVICE SERVICES
Where offered, PC build planning is a standalone technical advice service separate from a full system build contract. This service includes component recommendations, compatibility guidance, and budget architecture planning. Unless explicitly stated in writing, it does not include physical assembly, hardware procurement, or warranty handling for self-built systems. Advice is provided with reasonable care and skill based on market availability at the time of consultation.
9. SHOP GOODS
Our online shop provides carefully sourced technology, tested components, refurbished systems, pre-owned items, and selected spares or repair listings. Product availability varies dynamically. Every direct listing explicitly details the item's condition, what accessories are included, specific delivery options, and any applicable warranty or returns parameters.
10. REFURBISHED AND USED GOODS
Refurbished and used goods may show reasonable, minor signs of prior cosmetic use and are described honestly. Batteries, consumable components, and age-related performance variables may vary unless explicitly guaranteed in writing. Disclosed aesthetic wear or minor age-related baseline traits are accepted prior to sale and are not treated as hardware faults. Refurbished items remain subject to your core statutory consumer rights.
11. REPAIRS, DIAGNOSTICS, AND UPGRADES
Repair and upgrade services focus exclusively on desktop PCs. Some complex or intermittent hardware stability issues require a formal, initial diagnostic bench assessment before a final repair or upgrade quote can be confirmed. We will openly advise if a device or component is completely uneconomical to upgrade or repair. We do not offer micro-soldering, advanced motherboard circuit track re-weaving, or component-level liquid damage restoration.
12. CUSTOMER RESPONSIBILITIES FOR REPAIRS
You are solely and completely responsible for backing up all personal data, software applications, keys, and operating configurations before submitting any desktop, drive, or component for diagnostics, repair, upgrade, or workshop service. You must provide accurate information regarding system faults, passwords, encryption parameters, and modifications.
13. DATA LOSS DISCLAIMER
ConstructPC Ltd accepts absolute zero liability or responsibility for data loss, file corruption, or software licence deactivation occurring during diagnostic profiling, hardware updates, or repair services. Customers must ensure all critical data is securely backed up off-site before any hardware is submitted to us.
14. PRICING AND PAYMENT
All prices are stated in GBP (£). Payment terms are outlined explicitly at checkout, invoice, or point of sale. Unless otherwise agreed in writing, custom builds require full payment before components are ordered from distributors; shop goods require full payment clear time before dispatch; and repairs require full settlement before physical handover or return delivery. Any credit or pay-in-instalments options are managed entirely by independent third-party payment providers (e.g., Stripe, PayPal, Klarna) and are subject strictly to their independent terms.
15. DEPOSITS
Where a deposit is required to secure a build queue or technical allocation, its purpose and refund status will be confirmed in writing before payment is taken. Deposits used to secure non-returnable components or begin bespoke work may be non-refundable once liabilities are incurred with distributors, subject to your statutory consumer rights.
16. DELIVERY METHODS
Delivery options include third-party tracked couriers, local hand delivery by ConstructPC Ltd personnel, or pre-arranged local collection. Large, fragile, tempered glass, or high-value fully assembled custom systems may be restricted to local collection or dedicated hand delivery at our discretion unless robust, specialised packaging arrangements are formally agreed.
17. COURIER DELIVERY
Courier delivery is carried out by vetted third-party providers using tracked services where practical. Delivery dates are non-binding estimates. Risk passes to you upon delivery of the package to the shipping address provided. You must inspect the goods promptly and report any visible transit damage or missing items to support@constructpc.co.uk within 48 hours of receipt, providing comprehensive photographic evidence.
18. HAND DELIVERY AND COLLECTION
For hand delivery executed directly by us, risk passes upon physical handover to you or your designated recipient at the destination threshold. For local collection, risk passes completely when the goods leave our physical premises. Handover verification pins or signatures may be required.
19. DAMAGE IN TRANSIT
If goods arrive physically damaged by the courier, you must contact support@constructpc.co.uk immediately. You must retain all internal/external packaging, courier labels, shipping boxes, and contents to support a courier insurance claim. Failure to retain all original packaging materials or delaying notice beyond 48 hours may invalidate the transit claim investigation.
20. CANCELLATION RIGHTS (STANDARD GOODS ONLY)
For eligible distance sales of Standard Goods only, consumers have a statutory 14-day cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This cooling-off right does not apply to custom builds, personalised items, unsealed items not suitable for return due to health or hygiene reasons, or services fully performed with your prior agreement. Cancelled standard items must be returned completely unused, unmodified, and complete in their original, undamaged retail packaging.
21. RETURNS PROCESS
You must contact us to secure formal authorisation before returning any item; unauthorised shipments may be delayed, tracked as unknown, or refused. Unless the item is faulty, you are completely responsible for return postage fees, secure packaging arrays, and all transit risks. Refunds may be reduced if items show signs of handling, configuration, or assembly beyond a basic visual inspection.
22. FAULTY GOODS & STATUTORY REMEDIES
Any goods found to be faulty, non-conforming, or misdescribed will be handled strictly in accordance with the tiered remedy framework established under the Consumer Rights Act 2015:
Within 30 Days of Delivery: You possess an absolute short-term statutory right to reject the non-conforming goods and claim a full refund.
Between 30 Days and 6 Months: You are entitled to a repair or replacement. ConstructPC Ltd is legally permitted one (1) attempt to repair or replace the defective hardware. If this single repair attempt is unsuccessful, or cannot be completed within a reasonable timeframe without significant inconvenience to you, you may exercise your final right to reject the goods for a full refund or demand an appropriate price reduction.
After 6 Months: The burden of proof shifts to the consumer to demonstrate that the fault was present inherently at the point of delivery. All reported faults must undergo comprehensive diagnostic validation at our workshop before any statutory remedy is authorised.
23. SERVICES & 90-DAY WORKMANSHIP GUARANTEE
Technical services will be executed with reasonable care and skill. In alignment with our frontend service promises, all desktop upgrade and repair work includes a 90-Day Workmanship Guarantee for the specific work completed. If the identical technical issue returns within 90 days of completion explicitly because of the original installation or repair workmanship, ConstructPC Ltd will inspect and rectify the issue without an additional labour charge. This guarantee applies strictly to the isolated component or installation pathway handled during the original service and excludes newly arising, unrelated hardware failures, software/driver updates, user-inflicted physical damage, or tampering.
24. 3-YEAR CONSTRUCTPC BUILD SUPPORT
Every new custom-built desktop PC includes our comprehensive 3-Year ConstructPC Build Support framework from the date of handover:
First 12 Months: Includes a full workshop workmanship and assembly guarantee covering hardware faults caused by the original assembly, component configuration, or technical installation work.
Years 2 and 3 (Months 13 to 36): Throughout the remainder of the 3-year support period, ConstructPC Ltd provides continuous technical diagnostics and help desk support to isolate hardware faults and assist you in managing valid component manufacturer Return Merchandise Authorization (RMA) claims for parts supplied as part of your original build layout.
Component Logistics: Individual internal components remain protected by their respective manufacturer warranties, which vary by vendor. ConstructPC Ltd handles direct troubleshooting checks, but final warranty RMA item approvals, component replacements, and manufacturer turn times are dictated entirely by the respective component hardware vendors.
25. PERFORMANCE & HARDWARE BENCHMARKS DISCLAIMER
System performance, operating frame rates (FPS), and synthetic software benchmarks vary depending on driver revisions, software patches, game engine updates, ambient room thermals, and specific in-game configuration profiles. ConstructPC Ltd does not guarantee specific frame rates or benchmark metrics unless expressly agreed in writing prior to production.
26. SOFTWARE, LICENCES, AND OPERATING SYSTEMS
Software configuration and driver deployments are executed with reasonable care. You remain solely responsible for obtaining valid, legal software licences unless an operating system or software activation key is supplied as an authorised line item on your invoice. We hold no liability for third-party software bugs, developer platform restrictions, or system updates that break software compatibility.
27. COMPATIBILITY
We take reasonable technical care to verify hardware and firmware compatibility for upgrades and custom builds. Compatibility remains subject to shifting manufacturer firmware revisions, motherboard BIOS updates, and physical tolerance disclosures provided by component vendors.
28. CUSTOMER-SUPPLIED PARTS
Where we agree to install parts supplied directly by you, we accept absolute zero responsibility or liability for their authenticity, performance, prior damage, missing internal accessories, firmware states, or vendor warranty status. Standard technical bench labour charges apply even if customer-supplied parts prove defective, unstable, or dead on arrival during stability testing arrays.
29. PHOTOGRAPHY AND QUALITY RECORDS
We reserve the right to photograph or video system builds, component serial numbers, completed layouts, and transit packaging states for quality control, courier evidence records, and fraud prevention. Identifiable personal data will never be published on public marketing channels without your explicit consent.
30. UNCOLLECTED & ABANDONED HARDWARE
ConstructPC Ltd operates as a legal bailee of hardware submitted to our workshop for diagnostics, upgrades, or repair services. If a completed system remains uncollected, or if an itemised technical invoice remains completely unpaid for more than 60 calendar days following our formal Notice of Completion, ConstructPC Ltd will issue a strict, final 14-day statutory warning notice to your registered contact email in strict compliance with the Torts (Interference with Goods) Act 1977. Failure to settle outstanding bench fees, parts outlays, and accrued storage costs before the expiration of this statutory notice period will result in the hardware being sold, repurposed, or disposed of to recover our documented financial losses.
31. COMPLAINTS
Customer satisfaction is paramount. If you are dissatisfied with a component, build assembly, or service layout, please submit your concern primarily via our dedicated Complaints Form, which is accessible through the "RAISE A CONCERN" link on our Contact page or via the link in our global website footer. 32. LIMITATION OF LIABILITY
Nothing in these Terms limits or excludes liability for death or personal injury caused by our proven negligence, fraud, fraudulent misrepresentation, or any liability which cannot be excluded or limited by applicable English law. To the maximum extent permitted by law, our total liability under or in connection with any contract is strictly limited to the total price paid by you for the specific goods or services in dispute. We are not liable for indirect, special, or consequential losses, including loss of profit, loss of business, revenue loss, data loss, or third-party liabilities.
33. EVENTS OUTSIDE OUR CONTROL (FORCE MAJEURE)
We are not liable for any failure or delay in performing our obligations caused by events outside our reasonable control, including third-party courier delays, global component market shortages, severe weather blocks, regional power or internet outages, or payment gateway service disruptions.
34. INTELLECTUAL PROPERTY
All website design, source configuration, branding assets, custom text blocks, layouts, images, and marketing materials are owned by or licensed directly to ConstructPC Ltd and may not be reproduced, copied, or scraped without explicit written permission.
35. CHANGES TO THESE TERMS
We reserve the right to update these Terms from time to time to reflect regulatory shifts or platform updates. The specific version live on our website at the time you place your order, pay an invoice, or approve your quote will govern that specific contract.
36. GOVERNING LAW AND JURISDICTION
These Terms are governed entirely by the laws of England and Wales. Any disputes, claims, or legal proceedings arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
