1. INTRODUCTION

These Terms and Conditions govern the sale of goods and provision of services by ConstructPC Ltd (“ConstructPC”, “we”, “us”, “our”) to customers (“you”, “your”).

By placing an order, requesting services, approving a quotation, or purchasing goods from us, you confirm that you have read, understood, and agree to these Terms and Conditions.

Nothing in these Terms affects your statutory rights.

3. DEFINITIONS

“Custom Build” means a PC or system built, configured, assembled, or supplied to your agreed specification.

“Standard Goods” means goods sold from stock which have not been built, modified, configured, personalised, or supplied to your bespoke specification.

“Refurbished Goods” means pre-owned, repaired, tested, cleaned, restored, or prepared goods sold as refurbished, used, pre-owned, repaired, or similar.

“Services” means diagnostics, upgrades, repairs, installation, configuration, setup, advice, consultation, or other work carried out by ConstructPC.

“Quotation” means an estimated price or proposal provided before work begins.

4. BUSINESS MODEL AND SERVICES

ConstructPC Ltd provides a hybrid range of goods and services, including:

- Custom-built desktop PCs;

- Desktop PC upgrades and performance improvements;

- Desktop diagnostics and practical repair services;

- Refurbished, used, pre-owned, repaired, or prepared technology;

- Individual computer components;

- Laptops, desktops, consoles, handhelds, accessories, and other technology sold via the shop;

- PC build planning and advice services, where offered.

Custom builds and local services are primarily offered in Northwich, Cheshire, and the surrounding region, with possible expansion across the North West. Shop items may be offered for delivery across the UK where suitable and where stated.

5. ORDERS AND ACCEPTANCE

A contract is formed only when we confirm acceptance of your order in writing or begin providing the goods or services, whichever happens first.

We may refuse or cancel an order where goods or parts are unavailable; pricing or product information is incorrect; the order is unsuitable, unsafe, fraudulent, or impractical; payment has not been received; or the requested work falls outside the services we provide.

6. QUOTATIONS AND ESTIMATES

Quotations are based on the information available at the time and are valid only for the period stated.

Component prices and availability may change without notice due to market conditions, supplier availability, exchange rates, or stock changes.

A quotation is not a guarantee of availability until accepted and paid where required.

Where additional work, parts, or costs become necessary, we will seek your approval before proceeding wherever reasonably possible.

7. CUSTOM BUILDS

Custom-built systems are bespoke goods made to your agreed specification.

Specifications may be based on your stated needs and preferences, our recommendations, or a combination of both.

You are responsible for reviewing and approving the agreed specification before work begins.

Once parts are ordered, work has commenced, or assembly has begun, cancellation may not be possible except at our discretion.

Under Regulation 28 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, cancellation rights may not apply to goods made to a consumer’s specification or clearly personalised.

This does not affect your statutory rights if goods are faulty, not as described, or not fit for purpose.

8. PC BUILD PLANNING AND ADVICE SERVICES

Where offered, PC build planning may be provided as a paid advice service separate from a full custom build.

This may include component recommendations, budget planning, compatibility guidance, suggested suppliers, upgrade paths, and written specification guidance.

Unless expressly agreed, a PC build planning service does not include assembly, installation, procurement of parts, warranty handling, or aftersales support for self-built systems.

Advice is provided using reasonable care and skill based on the information available at the time. Prices, stock, compatibility, firmware requirements, and third-party specifications may change.

9. SHOP GOODS

Shop goods may include new, used, pre-owned, refurbished, repaired, tested, cleaned, or prepared technology.

Each product listing should state, where applicable, whether the item is new, used, refurbished, repaired, or pre-owned; any known cosmetic or functional condition; included accessories; warranty or returns terms; and delivery or collection options.

10. REFURBISHED AND USED GOODS

Refurbished and used goods may show reasonable signs of prior use unless stated otherwise.

Such goods are tested and described honestly to the best of our ability.

Batteries, consumable parts, cosmetic condition, previous wear, and age-related performance may vary unless expressly guaranteed.

Used and refurbished goods remain subject to your statutory rights.

11. REPAIRS, DIAGNOSTICS, AND UPGRADES

Repair and upgrade services are currently focused on desktop PCs unless otherwise agreed.

Services may include component replacement, desktop troubleshooting, operating system reinstallations, driver setup, BIOS or firmware updates, storage upgrades, graphics card upgrades, and general performance optimisation.

We do not currently offer highly specialised services such as micro-soldering unless expressly agreed in writing.

Diagnostics may identify faults, but not all faults are immediately visible or reproducible.

Some repairs may require replacement parts. We will seek approval before proceeding with material additional costs.

12. CUSTOMER RESPONSIBILITIES FOR REPAIRS

You are responsible for backing up all data before submitting any device, drive, or system for diagnostics, repair, upgrade, or service.

You must provide accurate information about faults, prior damage, passwords, encryption, modifications, previous repair attempts, and known risks.

We are not responsible for data loss, software loss, licence loss, account access issues, or loss caused by pre-existing faults.

13. DATA LOSS

ConstructPC Ltd accepts no responsibility for data loss.

Customers are solely responsible for ensuring all important data is backed up before any work is carried out.

Where data handling or recovery is requested, this must be agreed separately in writing.

14. PRICING AND PAYMENT

All prices are stated in GBP (£).

Payment terms will be stated at quotation, invoice, checkout, or point of sale.

Unless otherwise agreed in writing, custom builds require payment before parts are ordered or work begins; shop goods require payment before dispatch or collection; and repairs/upgrades may require payment for diagnostics, parts, labour, or completion before return.

We may offer payment through third-party providers such as card payments, PayPal, Klarna, Stripe, or other payment processors where available.

Any credit, finance, pay-in-instalments, or deferred payment option is subject to the third-party provider’s own terms, approval, fees, and eligibility checks. ConstructPC Ltd is not responsible for decisions made by third-party finance or payment providers.

15. DEPOSITS

Where a deposit is required, the amount, purpose, and refund status will be confirmed before payment.

Deposits used to secure parts, begin bespoke work, or reserve stock may be non-refundable once costs have been incurred.

This does not affect your statutory rights where goods or services are faulty or not provided with reasonable care and skill.

16. DELIVERY METHODS

Delivery may be provided by third-party courier, Royal Mail or postal service, direct hand delivery by ConstructPC Ltd where agreed, or local collection where agreed.

Not all products are suitable for courier delivery. Large, fragile, tempered glass, high-value, or fully assembled systems may be restricted to local delivery or collection unless suitable packaging and delivery arrangements are agreed.

17. COURIER DELIVERY

Courier delivery is carried out by third-party providers.

We aim to use appropriate packaging and suitable tracked or insured services where practical.

Delivery times are estimates and not guaranteed unless expressly stated.

Risk passes to you once goods are delivered to the address provided, except where the law provides otherwise.

You must inspect goods promptly on receipt and report visible damage, missing items, or delivery issues within 48 hours, with photographs where applicable.

18. HAND DELIVERY AND COLLECTION

For hand delivery, risk passes upon physical handover to you or your authorised recipient.

For collection, risk passes when the goods are collected.

You may be asked to confirm receipt, inspect the goods, or sign/acknowledge handover.

19. DAMAGE IN TRANSIT

If goods are damaged in transit, you must contact us as soon as possible and provide order details, photographs of the item, photographs of all packaging, and a description of the issue.

Courier claims may depend on prompt reporting and evidence. Failure to retain packaging may affect the ability to claim.

20. CANCELLATION RIGHTS

For eligible distance sales of Standard Goods, consumers may have a 14-day cancellation right under the Consumer Contracts Regulations 2013.

This right may not apply to custom-built goods, goods made to your specification, clearly personalised goods, sealed goods not suitable for return once unsealed, digital content or services where rights have been validly waived, or services fully performed with your agreement before the cancellation period ends.

Where cancellation rights apply, goods must be returned unused, in original condition, with original packaging and accessories where possible.

21. RETURNS

You must contact us before returning any item.

Unauthorised returns may be refused or delayed.

Unless the item is faulty or we agree otherwise, you are responsible for return postage, safe packaging, and ensuring returned goods are received undamaged.

Refunds may be reduced where goods have been handled beyond what is necessary to inspect them.

22. FAULTY GOODS

If goods are faulty, not as described, or not fit for purpose, we will deal with the matter in accordance with the Consumer Rights Act 2015.

Depending on the circumstances, this may include repair, replacement, price reduction, or refund.

You must give us reasonable opportunity to inspect, test, diagnose, and where appropriate repair or replace the goods.

23. SERVICES AND WORKMANSHIP

Services will be provided with reasonable care and skill.

If a service is not carried out with reasonable care and skill, you may be entitled to repeat performance or a price reduction under the Consumer Rights Act 2015.

24. WARRANTIES

Manufacturer warranties may apply to individual components and products.

ConstructPC Ltd does not currently provide insurance-backed warranties unless expressly stated.

Where manufacturer warranty exists, you may be required to deal directly with the manufacturer or supplier, although we may assist at our discretion.

Warranty does not cover accidental damage, liquid damage, misuse, neglect, physical damage after delivery, unauthorised modifications or repairs, overclocking damage, unsupported BIOS/firmware changes, software issues not caused by our work, normal wear and tear, or cosmetic wear on used/refurbished goods unless misdescribed.

25. PERFORMANCE DISCLAIMER

Performance may vary depending on software, drivers, firmware/BIOS versions, game or application optimisation, operating system updates, thermals, settings, user environment, monitor resolution and refresh rate, and third-party benchmarks.

We do not guarantee specific frame rates, benchmark scores, render times, or performance outcomes unless expressly agreed in writing.

26. SOFTWARE, LICENCES, AND OPERATING SYSTEMS

Where software, operating systems, or drivers are installed, this will be done using reasonable care.

You are responsible for ensuring you have valid licences for paid software unless the licence is supplied as part of the order.

We are not responsible for third-party software bugs, updates, account restrictions, licence issues, or platform changes.

27. COMPATIBILITY

We take reasonable care to check compatibility for custom builds and upgrade services.

Compatibility may depend on manufacturer specifications, firmware revisions, BIOS updates, physical tolerances, power requirements, case clearance, cooling, and third-party documentation.

28. CUSTOMER-SUPPLIED PARTS

Where we agree to use customer-supplied parts, we are not responsible for faults, compatibility issues, missing accessories, prior damage, counterfeit items, or lack of warranty relating to those parts.

Labour charges may still apply if customer-supplied parts are defective or unsuitable.

29. PHOTOGRAPHY AND QUALITY RECORDS

We may photograph goods, builds, packaging, damage, serial numbers, or completed work for quality control, insurance, courier evidence, warranty handling, fraud prevention, or record keeping.

We will not publish identifiable personal data without consent.

30. COMPLAINTS

Our complaints process is set out in our Complaints Policy.

We aim to acknowledge complaints within 2–3 working days and provide a full response within 7–14 working days where reasonably possible.

31. LIMITATION OF LIABILITY

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability which cannot be excluded by law.

To the fullest extent permitted by law, our liability is limited to the price paid for the relevant goods or services.

We are not liable for indirect or consequential loss, including loss of profit, loss of business, loss of data, loss of opportunity, or third-party losses.

32. EVENTS OUTSIDE OUR CONTROL

We are not liable for delays or failure caused by events outside our reasonable control, including courier delays, supplier shortages, strikes, severe weather, power outages, internet outages, payment processor issues, legal restrictions, or component market disruption.

33. INTELLECTUAL PROPERTY

All website content, branding, text, images, and materials created by ConstructPC Ltd are owned by or licensed to ConstructPC Ltd unless otherwise stated.

You may not copy, reproduce, or use our content without permission.

34. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The version in force at the time of your order will apply to that order.

35. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of England and Wales.

Any disputes will be subject to the courts of England and Wales, except where consumer law provides otherwise.
